Court Description: Judge Michael A. Ponsor: MEMORANDUM AND ORDER entered. As follows: Upon de novo review, the court hereby ADOPTS the Report and Recommendation of Judge Neiman dated February 17, 2011 (Dkt. No. 78 ). The damages to be awarded against Defendant XP will be in the amount of $23 million with attorneys fees in the amount of $24,600.00. Plaintiff may be assured that this finding will have no bearing on the continuing litigation between Plaintiff and USA Rugby and the counterclaim back by USA R ugby against Plaintiff. These claims remain for further adjudication. Based on the lack of opposition, the court hereby ALLOWS USA Rugbys Motion for Default Judgment on the crossclaim of XP (Dkt. No. 80 ). The court will decline to issue separate ju dgment pursuant to Fed. R. Civ. P. 54(d). Thus, the adoption of Judge Neimans Report and Recommendation, and the allowance of USA Rugbys motion against XPs cross-claim will create no appealable judgment.
